Agreement to Terms
By accessing or using any application developed by UgurSoftware Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our applications.
Use License
Permission is granted to download and use our applications for personal, non-commercial use only. This license does not include:
- Modifying or copying the application materials
- Using the materials for any commercial purpose
- Attempting to decompile or reverse engineer any software
- Removing any copyright or proprietary notations
- Transferring the materials to another person
This license shall automatically terminate if you violate any of these restrictions and may be terminated by UgurSoftware at any time.
Subscriptions
Some of our applications and games offer subscription-based access to premium features. By purchasing a subscription, you agree to the following terms:
Billing
- Subscriptions are billed through Apple's App Store
- Payment will be charged to your Apple ID account upon confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
No Refunds
All subscription payments are final and non-refundable. We do not provide refunds or credits for any partial subscription periods, unused features, or any other reason.
Cancellation
You may cancel your subscription at any time through your Apple ID account settings. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will continue to have access to premium features until the end of the current period
- Your subscription will not renew for the following billing period
- No refund will be provided for the current or any previous billing periods
This cancellation and no-refund policy applies to all UgurSoftware applications and games that offer subscriptions.
In-App Purchases
Some of our applications offer one-time in-app purchases. All purchases are processed through Apple's App Store and are subject to Apple's payment terms.
All in-app purchases are final and non-refundable. If you believe you have been charged in error, you may contact Apple directly through their standard process at reportaproblem.apple.com.
App Store Terms
Our applications are distributed through Apple's App Store. Your use of our apps is also subject to Apple's Terms and Conditions. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App Store.
User Content
Some of our applications may allow you to create, upload, or share content. You retain ownership of any content you create. By using our applications, you grant us a non-exclusive license to use, display, and process your content as necessary to provide our services.
You agree not to upload content that:
- Violates any applicable laws or regulations
- Infringes on intellectual property rights
- Contains malicious code or harmful content
- Is offensive, abusive, or inappropriate
Disclaimer
Our applications are provided "as is" without warranties of any kind, either express or implied. We do not warrant that:
- The applications will be error-free or uninterrupted
- Defects will be corrected
- The applications are free of viruses or harmful components
- The results obtained from using the applications will be accurate
Limitation of Liability
To the maximum extent permitted by law, UgurSoftware Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use our applications
- Any unauthorized access to your data
- Any third-party conduct or content
- Any content obtained from our applications
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or our applications shall be resolved in the courts of Bernalillo County, New Mexico.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of our applications after changes constitutes acceptance of the new Terms.
